***Latest News***January 2010-Another success for attorney Marko Burgar! After over a year
of stubbornly litigating a drug possession charge in a metro Atlanta county, Mr. Burgar
obtained a full dismissal of all charges for our client.  Our client was charged with drug
possession when the driver of a car he had ridden in was arrested for DUI.  Marko Burgar
was able to show a lack of connection between the two parties and the dubious tactics of the
arresting officers in associating our client with the incident.

***Latest News***January 2010-A huge success for attorney Marko Burgar in defending a
client accused of Rape and Aggravated Sexual Battery in a suburban Atlanta jurisdiction.  With
client was facing a life sentence, we undertook an expansive investigation of the
circumstances of his case which allowed us to present a defense based on the manner of
transmission of sexually transmitted diseases, which presented a powerful case that our
client could not have been involved in the alleged assault.  Combined with our location and
identification of several key witnesses, this defense led to the State abandoning sexual
assault charges against our client, leaving us with only with relatively minor charges to
resolve.  

***Latest News***January 2010-A joint effort by attorneys Marko Burgar and Darrell Kimbrell
led to the state abandoning a DUI charge against our client in Cobb County.  It was shown
that while there was a serious accident and the client had a history of DUI, there was simply
not enough evidence to prove he was DUI on this occasion.

***Latest News***January 2010-After 23 months of litigation, attorney Marko Burgar obtained
the dismissal of DUI and Minor in Possession of Alcohol charges levied against our client in
Paulding County, Georgia.  Mr. Burgar proved more stubborn than the prosecution in
outlasting the state in defense of charges we viewed as entirely inappropriate given the
known facts of the case.

***Latest News***November 2009-After 18 months of litigation, attorney Marko Burgar
obtained the dismissal of DUI charges in Atlanta that had been levied against our client.  The
result allowed our client, a U.S. Soldier, to accept deployment to Afghanistan, a challenge that
had been delayed as a result of the state's prosecution.  We wish our client Godspeed and a
safe return upon the completion of this tour.

September 2009-Attorneys Darrell Kimbrell and Marko Burgar obtained the prompt reduction
of DUI charges for a client accused in a suburban Atlanta county.  In a case that on the
surface seemed to be a vanilla DUI and an easy win for the State, Mr. Kimbrell and Mr. Burgar
uncovered a wholly incompetent investigation on the part of the arresting officers and quickly
obtained concessions from the prosecutors.  The client, eager to resolve her case, accepted
the state's offer to plead to a traffic offense rather than wait for trial.

August 2009-Client was arrested and charged with Theft by Conversion in 2008 in Cobb
County.  In September 2008, client took a plea on the Theft by Conversion charge under the
First Offender Act in the Superior Court of Cobb County.  Client reported to the probation officer
once in October 2008 and never reported again, did not pay any money towards the restitution
which had been ordered and never paid any money on the probation fees.  In August 2009,
client was picked up on a violation of probation warrant and attorney P. Darrell Kimbrell was
engaged to represent client.  Attorney P. Darrell Kimbrell met with client's probation officer and
was able to successfully negotiate a resolution to the case that allowed the client to keep the
First Offender treatment and to be released from custody on the day the revocation order was
signed.  Another successful defense for the attorneys of Kimbrell & Burgar, LLC.

July 2009-Client from Brazil was arrested in the City of Atlanta in June 2007 and charged with
Driving Under the Influence and Failure to Maintain Lane.  Client was involved in a single car
accident where he ran off the road and struck a tree.  When he blew on the Intox 5000
machine at the City of Atlanta Detention Center, his BAC registered a .120.  His case was
transferred from the City of Atlanta Municipal Court to the State Court of Fulton County for a jury
trial.  Client hired attorney P. Darrell Kimbrell of Kimbrell & Burgar, LLC to represent him once
he received notice that his case was set for trial in May 2009.  At the May 2009 calendar,
attorney P. Darrell Kimbrell appeared on client RM's behalf and announced ready and the
State requested a continuance because of one of its officers was unavailable and the case
was continued to the July 2009 calendar.  Attorney P. Darrell Kimbrell appeared with client,
RM, at the July 2009 trial.  The State was unable to successfully prosecute client, RM and
client's charges of DUI and Failure to Maintain Lane were dismissed against him.  Client has
no convictions for any offense and is now able to pursue his US citizenship without any
criminal charges against him.  Another successful defense for the attorneys of Kimbrell &

July 2009- After nearly a year of litigation, Kimbrell & Burgar, LLC, attorney secured the
reduction of DUI charges in a southern Atlanta county for a client accused of being a DUI
recidivist.  Key  victories in pretrial hearings led to the excellent compromise result that saved
the client's job and driver's license.

June 2009- Kimbrell & Burgar, LLC, attorney Marko Burgar negotiated the complete dismissal
of DUI and related charges against a metro Atlanta client.  Mr. Burgar illustrated the excellent
field performance of the client, as well as the dubious tactics of the arresting officer in
convincing the state to abandon the prosecution.

June 2009- Kimbrell & Burgar, LLC, attorney Marko Burgar secured the dismissal of DUI
charges that had been levied against a client in Atlanta.   Mr. Burgar successfully argued the
alleged evidence of impairment due to alcohol was indistinguishable from the normal
symptoms expected from injuries due to a severe accident.

May 2009- Kimbrell & Burgar, LLC, attorney Marko Burgar obtained the complete dismissal of
charges against a client accused in Gwinnett County of possession with intent to distribute
methamphetimine and ecstasy, and possession of  clonazapam (Klonopin).  Our client's
co-defendant was convicted and sentenced to ten years in prison.

April 2009- Another "not guilty" jury verdict for a Kimbrell & Burgar, LLC, client.  In a suburban
Atlanta matter, attorney Marko Burgar successfully argued to the jury that the arrest videotape
of our client completely contradicted the prosecutor's suggestion that the accused was a less
safe driver due to the influence of alcohol.

March 2009- Kimbrell & Burgar, LLC, attorney Marko Burgar secured the dismissal of DUI and
related charges against a client accused of Driving Under the Influence in Atlanta.  Mr. Burgar
was able to establish the complete lack of evidence suggesting the accused was intoxicated.

March 2009- In a novel legal maneuver, Kimbrell & Burgar, LLC attorney P. Darrell Kimbrell
secures the dismissal of felony Theft by Shoplifting charges against client, C.E.T., in Cobb
County Superior Court.  Client was arrested along with his paramour for allegedly stealing a
high definition video camera from Best Buys in December 2008.  Client was taken into
custody and placed in the Cobb County Adult Detention Center.  Client could not post bond to
be released from custody as there was a hold on him from another jurisdiction.  Attorney was
brought in to represent the client and filed a Motion to Dismiss or Indict in late February 2009.  
In less than 9 days, the client's charges had been dismissed by the District Attorney's office
and the client was released from the Cobb County Detention Center.  Another successful
outcome for the client's of Kimbrell & Burgar, LLC.

February 2009- Kimbrell & Burgar, LLC, attorney Marko L. Burgar obtains the dismissal of
DUI charges against an young driver after over two years of litigation in the Fulton County
State Court.

February 2009- We invite our readers to our new blog concerning DUI/DWI issues in Georgia
and the Metro Atlanta area.  

January 2009- Kimbrell & Burgar, LLC, attorney P. Darrell Kimbrell successfully obtains a
dismissal of DUI charges in a Cherokee County municipality.  With trial set to commence, Mr.
Kimbrell successfully argued the client rescinded her refusal in a timely fashion and should
have been afforded an opportunity to take a chemical test.

October 2008- Another win for Kimbrell & Burgar, LLC, attorney Marko L. Burgar, earning a jury
verdict of NOT GUILTY for his client.  Our client, who was under 21 years old at the time of the
incident, was accused of driving with a blood alcohol content of
.161 and rear-ending another
car.  After three years of litigation in Fulton County State Court, Mr. Burgar succeeded in getting
this matter before a jury, who gratefully returned a verdict of not guilty, exonerating our client of
the accusation of DUI.

October 2008- Kimbrell & Burgar, LLC, attorney Marko L. Burgar successfully obtains a new
trial on appeal for a client convicted of DUI in a Fulton County municipality.  Mr. Burgar was
asked to argue the appeal by a colleague in a case where the client was alleged to have had
a BAC of
.097.  Mr. Burgar successfully asserted procedural errors that required that the client
be given a new trial.

September 2008- Kimbrell & Burgar, LLC, attorney P. Darrell Kimbrell obtained the dismissal
of DUI charges in the City of Atlanta.   Our client was arrested in July 2008 by the City of Atlanta
police department and charged with DUI, Improper Turn and Reckless Driving.  Upon being
pulled over, our client refused the SFST's (standardized field sobriety tests) and refused to
take a state administered breath test.  At this point, he was arrested for DUI, Improper Turn
and Reckless Driving and taken into custody. The officers report stated that the client smelled
heavily of alcohol however the occupant of the vehicle disputed this contention by the officer.  
By refusing to consent to the testing, our client did not provide the State with any additional
evidence to use against him.  Upon presentation  evidence and submission of relevant law to
the State's prosecutor, the prosecuting attorney dismissed DUI charge against our client.

September 2008- Kimbrell & Burgar, LLC, attorneys Marko L. Burgar and P. Darrell Kimbrell
successfully argue for the withdrawal of DUI charges against an under-21 driver in Paulding
County.  Our firm was able to distinguish our client from the three other co-defendants who
were ultimately convicted of DUI.  Our client was accused by the officer of having a blood
alcohol content of
.111.

August 2008- Kimbrell & Burgar, LLC, attorney Marko L. Burgar convinces the prosecutor and
court in a DeKalb County municipality not to proceed with DUI charges against our client.  Mr.
Burgar successfully showed the evidence would not likely result in a conviction of the accused.


August 2008- A historic win for Kimbrell & Burgar, LLC, attorney P. Darrell Kimbrell.  With the
jury deadlocked after a trial of a client accused of DUI with a blood alcohol content of
.237, the
state reduced charges and abandoned efforts to charge our client with DUI.

July 2008- Kimbrell & Burgar LLC, attorneys Marko L. Burgar secures the dismissal of DUI
charges entered in DeKalb County against a client accused of driving under the influence of
marijuana.

June 2008- Kimbrell & Burgar LLC, attorneys Marko L. Burgar and  P. Darrell Kimbrell
successfully argue for the dismissal of DUI charges entered in Cobb County against a client
accused of driving under the influence of marijuana.

June 2008- The attorneys of Kimbrell & Burgar LLC, negotiated an over half-million dollar
resolution of a client's workers compensation claim for an incident where the client sustained
a burst fracture of his spine.  This settlement concluded over three years of litigation
concerning the employer's resistance to fully compensating our client.

April 2008- Kimbrell & Burgar LLC, attorney P. Darrell Kimbrell argues successfully in the
Cobb County courts obtaining an outright dismissal of all marijuana possession charges
levied against our client.

March 2008- Kimbrell & Burgar LLC, attorney P. Darrell Kimbrell makes successful legal
arguments that lead to the reduction of DUI charges that had been filed against a Gordon
County client with a history of prior DUI matters.  Mr. Kimbrell's victory was the product of a
lengthy and detailed investigation into the history and tactics of the officers involved.

March 2008- Kimbrell & Burgar LLC, attorney P. Darrell Kimbrell secures the dismissal of all
charges on behalf of client C. M., who was charged in the State Court of Cobb County with
Criminal Trespass for allegedly breaking windows in the house of her former paramour.  
Attorney P. Darrell Kimbrell of Kimbrell & Burgar, LLC took on her case and conducted an
detailed investigation on her behalf.  Upon presentation of attorney Kimbrell's investigation
results to the prosecuting attorney, the State made a decision to dismiss all the charges
against our client.  As a result of this dedicated effort by P. Darrell Kimbrell of Kimbrell &
Burgar, LLC, our client does not have a criminal record.

March 2008- Kimbrell & Burgar LLC, attorney P. Darrell Kimbrell's client had been indicted in
Cobb County Superior Court on January 31, 2008 and charged with Trafficking in
Methamphetamine, Possession of Tools to Commit a Crime and two counts of Forgery in the
First Degree as the result of an arrest by officers of the City of Acworth Police Department.  
She was alleged to have been in a motel room with her supplier when the police entered the
room with an arrest warrant for a violation of probation.  Once inside the motel room, the
drugs were alleged to be found along counterfeit currency, scales, printers and a computer.  
The case was prepared for trial with the client facing a mandatory minimum of ten years to
serve if convicted at trial.  During the course of his trial preparation, Mr. Kimbrell effectively
used all of the police officers internal affairs records as well as the officer's P.O.S.T. records
for the purpose of cross-examination. On the eve of trial, the matter was resolved to include
the dismissal of the Trafficking in Methamphetamine charge, the Possession of Tools to
Commit a Crime charge and one of the Forgery in the First Degree charges.  

February 2008- Kimbrell & Burgar, LLC, attorney Marko Burgar secures the dismissal of drug
trafficking charges against a client in Fulton County Superior Court.  The client was facing a
minimum sentence of ten years to serve and a $200,000.00 fine.  Our client was the only one
of several co-indictees to be cleared of all charges.  The matter involved a two-year
investigation into alleged cocaine distribution in North Fulton County.

August 2007- Kimbrell & Burgar, LLC, attorney Marko Burgar represented a major Peachtree
City developer in the sale of over 300 acres to a Chinese industrial firm.  A $30 million facility
will be built on the site for the manufacture of heavy equipment and later the company
headquarters and research facility.  This deal not only brings a substantial employer to the
community, but is also structured to preserve the unique character of the Peachtree City,
Georgia.

June 2007- The firm of Kimbrell & Burgar, LLC secures an outright dismissal of all drug and
weapon charges against client E.T. in the Superior Court of Cobb County.  This was our
client's second encounter with the Cobb County authorities within the past two years in drug
related matters.  In indictment #07-9-2720, our client had been accused of Possession of
Methamphetamine and Possession of a Firearm during the commission of a Felony.  She
was arrested inside a house during the execution of a search warrant where crystal meth was
located along with a Glock 9mm handgun.  After consideration of the evidence uncovered by
the firm of Kimbrell & Burgar, LLC, the prosecuting attorney decided to dismiss all charges
against our client.  Once again, justice prevails for the accused through the dedicated efforts
put forth by the attorneys of Kimbrell & Burgar, LLC

May 2007-Kimbrell & Burgar, LLC,  attorney P. Darrell Kimbrell secures the dismissal of a
Kidnapping with Bodily Injury and Aggravated Assault with Intent to Rape charges against J.L.
in the Superior Court of Cobb County.  Our client was indicted for Kidnapping with Bodily
Injury, Aggravated Assault with Intent to Rape and False Imprisonment.  Our client was facing
life in prison plus 30 years on these charges.  He was accused of kidnapping a female and
taking her to a wooded area, beating her, ripping her clothes off and attempting to have
forcible sex with her.  After an intense and exhaustive investigation by our firm, P. Darrell
Kimbrell presented his findings, thereby securing the dismissal of these serious charges. An
agreement was soon reached involving only minor ancillary charges.  Our client happily
accepted this negotiated plea as it meant he would soon taste the fresh air of freedom

client accused of DUI in Gwinnett County, Georgia.  Mr. Kimbrell successfully argued that the
state did not prove our client was under the influence of alcohol.

January 2007-Kimbrell & Burgar, LLC, attorney Marko L. Burgar secures the acquittal of client
charged with DUI in Fulton County State Court.  The client was alleged to have had a blood
alcohol content of .124.

January 2007-Kimbrell & Burgar, LLC, attorney P. Darrell Kimbrell invokes the First
Amendment of the Constitution to secure release of man unlawfully accused of obstructing
the police.

January 2007-Kimbrell & Burgar, LLC, attorney P. Darrell Kimbrell successfully clears a
police officer of false accusations for which the department sought to suspend pay and
decertify the officer with P.O.S.T.  Darrell Kimbrell won the appeal before the Civil Service

May 2006-Kimbrell & Burgar, LLC, attorney Marko L. Burgar secures the dismissal of DUI
charges in the Atlanta Municipal Court.  The state did not have sufficient evidence to a charge
a visiting Louisiana resident with the offense.
