Case Management

CIVIL/CRIMINAL CONSULTING SERVICES
We provide specialized consulting services to litigators and other civil law attorneys to
assist in the management of matters with a criminal law component. Our extensive
experience in both criminal and civil litigation matters arms us with the knowledge
necessary to communicate important information regarding criminal cases to civil
litigators, and further allows us to obtain the results in criminal cases critical to the
furtherance of civil case goals. It is important to understand that prosecutors act on
behalf of the State, and this interest very often differs from the interests of victims or
related third-parties. Active advocacy is generally necessary to see that this
divergence does not negatively impact a client's civil interests. Our background and
relationships in the criminal law arena allow us to both provide vital information and
obtain results necessary for our client's success in corresponding civil matters.
Examples of services we provide in this subject matter:
* Victim advocacy in fraud and fiduciary abuse matters: Steps must be taken to
confirm that criminal sentences account for (or defend against) the financial liabilities
that result from crimes, and that sentencing and enforcement are tailored to support
the satisfaction of these liabilities as opposed to the usual result that effectively
extinguishes a victim's ability to satisfactorily recovery losses. Further, civil claims
related to fraud, Ponzi schemes, and related criminal endeavors must account for
potential criminal ramifications that may complicate collections, discovery and the
ultimate resolution of the case.
* Providing clear metrics and risk profiles for criminal cases: An understanding of
possible outcomes and timetables for criminal matters is necessary for the
cost-effective pursuit of any related civil case. A failure to understand both the likely
outcome of a criminal case and the length of time necessary to get to that point will
generally lead to frustration and an ineffective use of resources. We provide detailed
analysis of related criminal cases to our clients that allow them to maximize their
ability to obtain efficient results. Further, our analysis allows our clients to, in turn,
better advise their clients on a cases likelihood of success and the potential array of
outcomes given a problematic criminal component.
* Management of problematic discovery issues: The involvement of a party or a
witness in a criminal matter is a difficult issue to manage. Both civil discovery rules
and the constitutional rights of the accused are negatively impacted, and for the civil
litigator, the ability to depose a witness or otherwise obtain necessary evidence is
often blocked. Our firm regularly negotiates solutions to such impasses, manages the
criminal and civil cases to find discovery methods were all parties are protected and
satisfied, or finds alternative sources for the needed information.
* Victim advocacy in traffic/personal injury matters: Georgia criminal procedure
provides certain protections to personal injury victims, but as a practical matter these
protections are not enforced without active and well-directed victim advocacy. It is
well known that the underlying result of a traffic citation can be either devastating or
bountiful to a civil action. Our firm's knowledge of the idiosyncrasies an peculiarities
of the various traffic courts help our clients see that their interests are protected and
that the best resolution is achieved.
* Victim advocacy in domestic and personal safety matters: In divorce cases,
domestic violence matters, and other matters of personal safety, the law provides
many methods to assist in personal protection. We provide advocacy services both
ends of this equation, whether it be to provide necessary protection, or to see that
rights are protected when this process is abused. As the result of these
quasi-criminal processes often have a substantial impact on civil matters, it is
important that our clients understand the impact these cases have on civil matters.
